Leon Lossy Auction

Terms

Terms & Conditions

Last updated 4 November 2026

These terms apply to every account, bid and purchase on leonlossyart.com. By creating an account you accept them. If you don't agree, please don't use the website.

1. Who we are

The seller is Léon David de Lossy (“Léon Lossy”, “we”), leonlossy@gmail.com. Enterprise number: registration in progress. VAT: not registered for VAT; no VAT is charged on sales. Our postal address and all other details are on the legal notice.

2. Accounts

  • You must be at least 18 years old and legally able to enter into a contract.
  • One account per person. Give your real name and a valid email address. You are responsible for what happens with your account.
  • We may suspend an account in case of abuse, fraud, fake bids or breach of these terms.

3. How the auction works

  • Each auction is for one original artwork by Léon Lossy. The description, photos, size, medium, starting price, opening and closing times are shown on the auction page.
  • To bid, you need an account and a saved payment card. Each bid must be at least the minimum amount shown.
  • A bid is binding. By placing it, you commit to buy the artwork at that price if you are the highest bidder when the auction closes. A bid cannot be withdrawn.
  • A bid placed in the last 5 minutes extends the auction by 5 minutes.
  • The highest valid bid at closing time wins. The contract of sale is formed at that moment.
  • We may cancel an auction or a bid in case of technical error, fraud or force majeure. In that case no payment is due, and any amount already paid is refunded.

4. Price

The price is the winning bid, in euros. Not registered for VAT; no VAT is charged on sales. Shipping costs are added on top and depend on the destination: see Shipping & returns.

5. Payment

  • Payments are handled by Stripe. We never see or store your full card number.
  • Saving a card charges nothing. Your card is charged only if you win: the winning bid is charged automatically when the auction closes.
  • For bids of €100 or more, your bank is asked to reserve (hold, not charge) the amount on your card when you bid. If your bank refuses, the bid is not placed. The reservation is released as soon as you are outbid, and collected if you win.
  • If the automatic payment fails, the winner can pay on their order page within 48 hours. After that, the sale is cancelled and the artwork may be offered to the next highest bidder at their own highest bid.

6. Shipping and delivery

After winning, you enter your delivery address and pay shipping on your order page. We ship with tracking, usually within 7 days of full payment, and send you the tracking number. Delivery times and prices are on the shipping page. The risk passes to you when you (or someone you appoint) receive the artwork.

7. The artwork

Each artwork is a unique original, made by hand. Small irregularities, texture and variations are part of the work and are not defects. Colours may look slightly different on screen.

8. Legal guarantee

Consumers benefit from the legal guarantee of conformity of 2 years from delivery (Belgian Civil Code). If the artwork arrives damaged or doesn't match its description, contact us within 2 months of noticing the problem, with photos, at leonlossy@gmail.com.

9. Right of withdrawal (14 days)

If you buy as a consumer, you have the right to withdraw from the purchase within 14 days, without giving any reason. The period starts the day you (or someone you appoint) receive the artwork.

  • How: send us a clear statement by email to leonlossy@gmail.com before the 14 days end. You can use the model form below, but you don't have to.
  • Return: send the artwork back, well protected, to the address on the legal notice within 14 days of telling us. Return shipping costs are paid by you. We recommend insured, tracked shipping.
  • Refund: we refund the price and the standard shipping cost you paid, within 14 days of your withdrawal, with the same payment method. We may wait until we have received the artwork back, or proof that you sent it.
  • You are responsible for any damage caused by handling the artwork beyond what is needed to inspect it.

Model withdrawal form (only fill in and send this if you want to withdraw)

To Léon David de Lossy, leonlossy@gmail.com (postal address: see the legal notice):
I hereby give notice that I withdraw from my contract of sale for the following artwork: [N° and title]
Won on: [date] · Received on: [date]
Name: [your name] · Address: [your address]
Date: [date] · Signature (only if sent on paper)

10. Live chat

  • Be respectful. No insults, harassment, hate, spam, links, personal data of others, or illegal content.
  • Messages are public. You are responsible for what you write.
  • Use the “Report” button on a message, or email leonlossy@gmail.com, to report a problem. We may delete messages and mute accounts that break these rules.

11. Liability

We do our best to keep the website available and accurate, but we can't guarantee it will always work without interruption. We are not liable for indirect damage. Nothing in these terms limits your rights as a consumer under Belgian law.

12. Personal data

How we use your data is explained in our Privacy Policy.

13. Complaints and disputes

Contact us first at leonlossy@gmail.com; we reply within 7 days. If we can't find a solution, consumers can contact the Belgian Consumer Mediation Service (Service de Médiation pour le Consommateur / Consumentenombudsdienst, North Gate II, Boulevard du Roi Albert II 8, 1000 Brussels, mediationconsommateur.be). These terms are governed by Belgian law. Disputes go to the competent Belgian courts, without depriving consumers of the protection of the law of their country of residence.

14. Changes

We may update these terms. The version that applies is the one you accepted when you placed your bid. If we change them, we'll ask you to accept the new version.
